లవ్ జీహాద్ కేసులో ట్విస్ట్! హదియాకు ఊరట, హైకోర్టు తీర్పును తప్పుబట్టిన సుప్రీం!

ఢిల్లీ: లవ్ జీహాద్ కేసులో కేరళ యువతి హదియాకు సుప్రీం కోర్టులో ఊరట లభించింది. ఈ కేసులో గతంలో కేరళ హైకోర్టు ఇచ్చిన తీర్పును తప్పుబడుతూ.. పెళ్లి విషయంలో ఒక స్త్రీగా ఆమె హక్కు ఆమెకు ఉంటుందని సుప్రీంకోర్టు స్పష్టం చేసింది.
ఎలా జీవించాలన్నదానిపై ఆమెకు పూర్తి స్వేచ్ఛ ఉంటుందని తెలిపింది.

కేరళకు చెందిన అఖిల ఆశోకన్‌(25) 2016 డిసెంబర్‌లో మతమార్పిడికి పాల్పడి హదియాగా పేరు మార్చుకుని షఫీన్‌ జహాన్‌ను వివాహం చేసుకుంది. అఖిల తండ్రి మాత్రం అది బలవంతపు మత మార్పిడి వివాహం అని ఫిర్యాదు చేయడంతో ఈ వ్యవహారం 'లవ్ జిహాద్ కేసు'గా మారి దేశ వ్యాప్తంగా కలకలం రేపింది. ఆ తరువాత కేరళ హైకోర్టు వివాహాన్ని రద్దు చేయటం.. కేసులో దర్యాప్తు కోసం ఎన్‌ఐఏకు అప్పగించటం తెలిసిందే.

అయితే హైకోర్టు తీర్పును సవాల్‌ చేస్తూ ఆమె భర్త షఫీన్‌ జహాన్‌ సుప్రీం కోర్టును ఆశ్రయించాడు. ఈ కేసులో విచారణ చేపట్టిన అత్యున్నత న్యాయస్థానం గురువారం కీలక ఆదేశాలు వెలువరించింది. హదియాకు తన భర్తతో కలిసి జీవించే హక్కు ఉందని చీఫ్‌ జస్టిస్‌ దీపక్‌ మిశ్రా నేతృత్వంలోని ధర్మాసనం వ్యాఖ్యానించింది.

ఈ వ్యవహారంలో జోక‍్యం చేసుకునే అధికారం దిగువ న్యాయస్థానానికి లేదని, కేరళ హైకోర్టు తీర్పు న్యాయ సమ్మతం కాదని.. వారి వివాహం వారి ఇష్టప్రకారం జరిగిందేనని సుప్రీం ధర్మాసనం పేర్కొంది. అంతేకాదు భర్త షఫీన్‌ తో జీవించేందుకు అఖిల అశోకన్ అలియస్ హదియాకు స్వేచ్ఛ ఉందంటూ స్పష్టం చేసింది.

గురువారం కేసు పూర్వాపరాలను పరిశీలించిన సుప్రీం ధర్మాసనం.. కేరళ ఉన్నత న్యాయస్థానం తీర్పును కొట్టివేసింది. అదే సమయంలోజాతీయ దర్యాప్తు సంస్థ(ఎన్‌ఐఏ)ను కేవలం ఉగ్ర కోణంలో మాత్రమే దర్యాప్తు కొనసాగించాలని, వైవాహిక జీవితంలో జోక్యం చేసుకూడదని ఆదేశించింది.

In a relief to Kerala-based Hadiya, an alleged victim of love jihad, the Supreme Court on Thursday set aside the high court order annulling her marriage to a Muslim man.A bench comprising Chief Justice Dipak Misra and justices A.M. Khanwilkar and D.Y. Chandrachud, however, said that the National Investigation Agency (NIA) may continue its investigation in the matter. The apex court had in August last year asked the NIA to probe the case of conversion and marriage of Hadiya, as the agency claimed a “pattern” was emerging in Kerala. The matter came to the fore when Shafin Jahan, Hadiya’s husband, had challenged a Kerala high court order annulling his marriage with her and sending the woman to her parents’ custody.
